A basket of groceries. A floor that should have had a warning sign on it and didn’t. A hip that hits tile before anyone can catch it. That’s how most public liability injuries actually start, not with drama, just a few seconds where somebody else’s oversight becomes your problem.

These accidents happen constantly, in shopping centres, restaurants, rental properties, the local park. And they set off two processes at once that people tend to treat as one thing. There’s the legal side: working out who was at fault, and what that’s worth. There’s the physical side: getting your body, and your ordinary week, back to where it was before you fell. Most guides only cover one of these. Both matter, and they don’t run on the same clock.

What actually counts as a public liability injury

A public liability injury is any injury you suffer on someone else’s property, or because of their negligence, and it’s a different animal from a workplace injury or a car accident. Slips on wet floors are the obvious example. Trips on broken paving, faulty playground equipment, a balcony that shouldn’t have given way: all of it sits under the same umbrella. What actually connects these cases isn’t the injury itself. It’s the question of whether whoever runs that space met a fairly basic duty to keep it safe.

That question decides whether a claim is worth pursuing at all, well before anyone starts talking numbers. And it’s rarely as clean-cut as it sounds. A clearly signposted hazard, or a risk you’d already been warned about, can undercut a claim considerably. Which is exactly why documenting things properly, from the first day, ends up mattering so much later.

How a public liability claim actually plays out

Forget the murky version most people imagine. The process is fairly linear. Report the incident to whoever manages the property. Photograph the hazard. Get names and numbers from anyone who saw it happen, because memories fade fast and CCTV footage gets overwritten within weeks if nobody asks for it in time.

From there, most people look into how a public liability claims process actually works before engaging a lawyer, who reviews what evidence exists and sends a letter of demand to whoever’s responsible. That opens negotiations with an insurer. Most of these claims settle without ever reaching a courtroom, which is the good news.

Here’s the less comfortable part: it can take well over a year, sometimes closer to two, before a claim of any real complexity is finished. Insurers want to see how an injury settles before they’ll agree to a number, and settling too early, before anyone knows the long-term picture, is how people end up under-compensated. Patience is annoying. It’s also usually the right call.

Recovery doesn’t wait for any of that

While a claim sits in someone’s inbox for months, life doesn’t pause. Getting dressed, driving, going back to work, picking up a kid from school: none of that waits on a letter of demand.

This is exactly where the legal and physical sides stop being separate stories. A well-documented recovery strengthens a claim. A properly supported recovery also gets someone back to their own life faster, regardless of what’s happening with the paperwork. Treat them as two threads of the same rope, not a queue.

Occupational therapy, and where it actually fits

People hear “occupational therapy” and think of something narrow, work-related maybe, or reserved for a specific type of injury. It isn’t. The whole discipline is built around one question: which parts of your day has this injury made harder, and how do we get you doing them safely again?

That starts with an honest look at what’s changed, at home, at work, in the small moments nobody notices until they’re suddenly difficult. Then comes the practical part: relearning how to move around your own house without pain, adapting a car or a workstation, building back the confidence to drive again. None of it follows a script. Progress gets checked and adjusted as it goes, because everyone’s injury behaves differently.

For someone recovering from a fall, occupational therapy services end up doing two jobs simultaneously. They rebuild the parts of daily life the injury took away, and they generate exactly the kind of documented, dated progress a claim often leans on. Skip one, and the other tends to move slower too.

What to do in the first 48 hours

Report the incident, in writing, not just a conversation. Photograph the hazard before someone quietly fixes it. See a doctor even if you feel fine, because some injuries take days to show themselves properly. Then get advice, legal and medical, before you decide what recovery or compensation should even look like.

The paperwork will take its time. There’s no reason your recovery has to wait alongside it.
